BARBIER, District Judge.
Before the Court are cross Motions for Partial Summary Judgment filed by plaintiffs (Rec.Doc. 50) and defendant (Rec.Doc. 56) which were heard with oral argument on July 19, 2000. Both motions are opposed.
In this case, plaintiff and other similarly situated individuals take issue with Louisiana’s policy regarding the provision of medically necessary services to disabled children.
