The petitioner, fee owner of Damage Parcel 117, in this proceeding seeks an order which would in effect compel the mortgagee of the property to accept payment of the unpaid principal amount of its mortgage out of an advance payment of the award for this parcel, with interest at 4% per annum from the date of the vesting of title, November 2, 1964 to March 10,1965, the date when the Comptroller of the City of New York was ready to make the advance payment.
