The plaintiff brings this action '’to' recover from the defendant bank for causing the wrongful death of the plaintiff’s intestate and also to recover damages for the decedent’s conscious pain and suffering. The substance of the allegations of the complaint is to the effect that the plainliff’s decedent, an employee of the Otis Eleva lor Company, was *584working in the elevator shaft or pit in a building in the city of Olean, New York, owned by the defendant.
