The plaintiff sues for damages resulting from an injury inflicted upon him by one of *10the defendant company’s trains, while, as a pedestrian, he was crossing its track. As to the place of the accident, it appears by the record that the track runs parallel to the west bank of the Willamette River. The plaintiff, at the time, was living in a house-boat on the river east of the railroad track and had resided there for about eight years prior to the accident.
