OPINION AND ORDER ON DEFENDANT’S MOTION TO DISMISS

WHEELER, Judge.

Before the Court is Defendant’s October 5, 2009 motion to dismiss Plaintiffs August 13, 2009 complaint for lack of subject matter jurisdiction, pursuant to Rule 12(b)(1) of the Rules of the Court of Federal Claims (“RCFC”) and 28 U.S.C. § 1500. This case concerns a settlement agreement that Plaintiff Darlene W. Low and her employer, the Southwestern Power Administration of the Department of Energy (“DOE”), entered into *449in the year 2000.
