This is an action in assumpsit instituted in this court under the provisions of section 16(b) of the Fair Labor Standards Act of June 25, 1938, c. 676, sec. 16, 52 Stat'. 1669, as *320amended, 29 U. S. C. §216(6), as enacted by the Congress of the United States, in which plaintiff seeks to recover overtime wages, the liquidated damages for failure to pay the same and a reasonable counsel fee.
