In August 2014, plaintiff “John Doe”1 enrolled as a freshman at James Madison University (JMU or University)-, a public institution, in Harrisonburg, Virginia; During his first week on campus, he met another freshman, “Jane Roe,”2 and the two had sex. A couple of months later, Roe filed a charge of sexual misconduct against Doe with JMU officials, accusing him of rape. In December, a hearing board held an evidentiary hearing on the charge.
