This is an appeal from a judgment rendered in action on the case by appellee against appellant, under Chapter 70 of the Bevised Statutes, which gives an action to the administrator of a deceased person, when the death of his intestate was caused by the wrongful act, neglect or default of any person or corporation, and which, if death had not ensued, Avould have entitled the intestate to maintain an action. The trial occurred in June, 1898, and was the second trial of the cause. The jury found for appellee, and assessed the damages at the sum of $2,500, and judgment was rendered on the…
