Appellees, Helen Mar-coulides and Mary T. Gonzales, brought this suit against appellants, Louis Lobit and Paul Lobit, as executors of the estate of Joseph Lobit, deceased, and as' individuals, to recover the sum of $5,753.81, which appellees had paid to said executors under protest, and with- the express understanding and agreement that such payment would not affect appellees’ right to thereafter sue for recovery of said sum.
