Appellant was convicted, upon a plea of guilty, of murder and his punishment was assessed by the jury at death.
At the trial, evidence was presented by the state which showed that the deceased operated a Fina service station on Highway 105 near Beach, in Montgomery County. On the day in question, the deceased left his home around 6 a. m. to go to the station. Around 6:30 a.m. his wife and stepson went to the station and discovered that he was not there.
