ORDER REGARDING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

SHERMAN G. FINESILVER, Chief Judge.

This matter comes before the Court on Defendant’s Motion to Dismiss for Lack of Subject Matter Jurisdiction, For Lack of Personal Jurisdiction, and For Failure to State a Claim Against the Defendant, filed on September 5, 1992. In its motion, Defendant submitted materials outside of the pleadings. Plaintiff did the same in its response. Accordingly, under Fed.R.Civ.P. 12(b), Defendant’s motion will be treated as one for summary judgment.
