The defendant was indicted by a grand jury in the Circuit Court of Marion County, for grand larceny under what is termed the Habitual Criminal Statute, Section 3702, Revised Statutes 1919. The indictment charged that in October, 1922, in the County of Marion, he feloniously, in the nighttime, stole thirty-four chickens of the value of $50, the property of Mary Glen denning; that previously he had been convicted in the Circuit Court of Marion County, in the year 1920, of larceny from a dwelling house, sentenced to serve, and did serve, two years in the penitentiary on said charge.
