HALL, District Judge.

The petitioner, Brandon Small, is a lawful permanent resident alien who is currently being detained at the Hartford Community Correctional Center. After serving a five-year sentence for possession of cocaine with intent to sell, the Immigration and Naturalization Service (“INS”) apprehended and detained the petitioner in August 2000 for removal pi-oceedings pursuant to 8 U.S.C. § 1227(a)(2)(A)(iii).
