The plaintiffs, David Gavlak and Hillside Springs Farm, Inc. (Hillside), have brought this federal action against the defendants, Town of Somers (Town) and the Somers Zoning Board of Appeals (Board), claiming that the defendants deprived them of their property without just compensation under the Fifth and Fourteenth Amendments and violated their rights to Due Process and Equal Protection under the Fourteenth Amendment. 1 The defendants moved to dismiss [Doc. 11] the plaintiffs’ complaint pursuant to Fed.
