THIS MATTER is before the Court on a Motion to Dismiss by Defendants Lamar Beach (“Beach”); J & L Enterprises, Inc. (“J & L”); Harry Charles Sinnamon (“Mr.Sinnamon”); Judy Ann Sinnamon (“Ms.Sinnamon”); Safe Divers, Inc. (“Safe Divers”); and Edwin Bussey (“Bussey”) (collectively “Defendants”) (filed July 6, 1999).
