The question to be determined in this case is the legality of a resolution of the state capitol commission/which resolution is as follows:
“Whereas, It appears to the state capitol commission that said commission can dispose of warrants on the state capitol building fund for the full amount of the unexpended appropriation for said state capitol at par in cash if issued on the letting of the contract for the superstructure of the capitol building, for which bids are or will be invited, and that by so doing the completion of said capitol…
