This is an original civil action, under article 7 of chapter 96, General Statutes of 1897 (Gen. Stat. 1899, §§ 4956-4963), to determine the right to the office of regent of the state agricultural college.

To the plaintiff’s petition the defendant files a demurrer upon three grounds : (1) That we have no jurisdiction of the person of the defendant; (2) that we have no jurisdiction of the subject-matter of the action; and (3) that the petition does not state facts sufficient to constitute a cause of action.
