LATTIMORE, Judge.

Appellant was convicted in the District Court of Hays County of murder, and given eighteen years in the penitentiary.

In view of our disposition of this case we shall discuss the facts no further than may be necessary to make plain our conclusions.

Appellant was a student in the University of Texas, and on the 9th or 10th of January, 1922, began boarding at the home of deceased under an arrangement, as testified to by him, made with Mrs. Ross, wife of deceased.
