MORROW, Presiding Judge. —

Murder is the offense; penalty assessed at confinement in the penitentiary for twenty-three years.

The deceased, George K. Gibbs, conducted a printing establishment in Woodville, Texas, and resided in the suburbs of the town. The two sons of the deceased, who were fourteen and nineteen years of age, worked in the printing office. An incident took place in which, as viewed by the younger son, persons not directly connected with the present offense, undertook to drive their automobile over the boy while he was riding on his bicycle.
