MEMORANDUM

I. Introduction

Dr. Joseph L. Sirois, Jr., the Debtor (“Si-rois” or the “Debtor”), filed a voluntary Chapter 7 petition on November 7, 1991. Pursuant to 11 U.S.C. § 522(b)(2)(A) 1 the Debtor, citing the anti-alienation provision of section 206(d)(1) of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1056(d)(1), 2 and Mass.Gen.
