Clifford Daugharty, plaintiff-appellant, (hereinafter referred to as “petitioner”) was convicted on November 19, 1951, in the circuit court of Deschutes County of the crime of uttering a forged check drawn on the Eugene Branch of the United States National Bank of Portland. On November 20, 1951, petitioner was sentenced to a term of 15 years in the Oregon State Penitentiary.

On December 9, 1954, petitioner filed a petition for a writ of habeas corpus in the circuit court for Marion County. Return was made by Clarence T. Gladden, defendant-respondent, (hereinafter referred to as “defendant”).…
