MEMORANDUM OPINION ON CROSS-MOTIONS FOR SANCTIONS

The debtor International Oriental Rug Center, Inc. (“Debtor”) filed for relief under Chapter 11 of the Bankruptcy Code, Title 11 U.S.C. On its motion, that proceeding was dismissed, but with reservation of jurisdiction over the pending cross-motions for sanctions.

The Village of Downers Grove (the ‘Village”), although not a creditor, moved under Fed.R.Bankr.P. 9011 to sanction Debtor for its filing of a motion against it and also for asserted bad faith filing of the bankruptcy petition. Debtor filed its…
