False imprisonment consists in the unlawful restraint of one person by another (McCarthy v. De Armit, 99 Pa. 63; Miller v. Ashcraft, 98 Ky. 314, 32 S. W. 1085; State v. Lunsford, 81 N. C. 528; Snead v. Bonnoil, 166 N. Y. 325, 59 N. E. 899), and malicious prosecution in an unsuccessful prosecution begun in malice and without probable cause. Auerbach v. Freeman, 43 App. D. C. 176.
