OPINION AND ORDER

PIERAS, Senior District Judge.

I. INTRODUCTION

The Court has before it the Commonwealth of Puerto Rico’s (“Defendant’s”) “Motion to Dismiss Pursuant to Fed Civ Rule 12(B)(1)” dated June 14, 2004 (docket No. 9). In such motion, Defendant requests the dismissal of Mr. José L. Camacho’s (“Plaintiffs”) “Petition for Writ of Habeas Corpus” dated April 29, 2003 (docket No. 1) because Plaintiff has allegedly failed to exhaust state remedies prior to bringing forth his § 2254 1 habeas corpus petition.
