See Real Estate Bar Ass’n for Mass. v. National Real Estate Info. Servs., 608 F.3d 110, 119-120 (1st Cir. 2010) (REBA III). The questions arise in the context of litigation pursued by the Real Estate Bar Association for Massachusetts, Inc.
