MEMORANDUM AND ORDER

CROW, District Judge.

The case comes before the court on the defendant City of Topeka’s (City) motion for summary judgment. (Dk. 33). The plaintiff brings this civil rights action pursuant to 42 U.S.C. § 1983 alleging he was demoted twice and eventually terminated in retaliation for reporting and speaking about two other city employees’ mishandling of public funds.
