Carlos Gene Moose (“Moose”) appeals the order entered June 23, 1992, in the Court of Common Pleas of York County denying his motion to dismiss the charges against him. 1 The complex factual and procedural history of this case follows. On February 10, 1988, the Commonwealth filed a complaint against Moose and Quinterio Smart (“Smart”) for the rape and murder of Judy Ketterman.
