MARGOLIS, Senior Judge.

This action is before the Court on defendant’s motion to dismiss Counts I and II of plaintiffs complaint. Plaintiff, Huntleigh USA Corporation (“Huntleigh”), filed a complaint against defendant, the United States, alleging two counts. First, plaintiff alleges that defendant violated the Takings Clause of the Fifth Amendment to the United States Constitution when it federalized airport security at all domestic commercial airports thereby displacing Huntleigh, who had previously provided these services to various air carriers.
