GEORGE C. HANKS, JR., Justice.

A jury convicted appellant, Helen Kian-sky Kamen, of driving while intoxicated. See Tex. Penal Code Ann. § 49.04 (Vernon 2003). The trial court assessed punishment at 180 days in jail, probated for 15 months, plus additional fines, fees, and community service. We issued our memorandum opinion on May 7, 2009, affirming the conviction. Appellant has filed a motion for rehearing arguing that this Court erred in holding that the trial court did not abuse its discretion in denying appellant’s motion to suppress testimony regarding the HGN test…
