Defendant appeals from a judgment of conviction for driving under the influence of intoxicants, ORS 813.010, and violation of the open container law, ORS 811.170. Defendant assigns error to the trial court’s denial of his motion to suppress evidence, arguing that the underlying stop for a traffic violation was unsupported by probable cause. In particular, defendant asserts that, because the arresting officer’s own conduct caused defendant to swerve outside his lane, the officer lacked probable cause to stop him for failing to drive within his lane.
