At the conclusion of a jury trial, the defendant was found guilty of first-degree criminal sexual conduct. The Court of Appeals affirmed the defendant’s conviction, rejecting his argument that the circuit court committed an error that required reversal when it failed to give a requested instruction on third-degree esc. We agree that the defendant’s conviction should be affirmed.
