The plaintiff brought this action of tort in four counts alleging ■ negligence: First, against the three defendants doing, -business as Weg Auto Co. (Weg) to recover for conscious suffering caused by injuries inflicted on her intestate (her husband). Second, against each of the defendants individually to recover for the wrongful death of her intestate under G. L. c. 229, § 2. The jury returned a verdict for the plaintiff on the first count and for the defendant on each of the last three counts. The case is here on a consolidated bill of exceptions.
