MEMORANDUM OPINION
This case involves the plaintiffs attempts to obtain reimbursement for services provided to medicare patients for occupational therapy (“OT”) and speech therapy (“ST”) services during the 1993 fiscal year. Currently pending before the court are the parties’ cross-motions for summary judgment. Summary judgment is appropriate when there is “no genuine issue as to any material fact and ... the moving party is entitled to judgment as a matter of law.” Fed.R.Civ.P. 56(c).
