This is an appeal by defendant from judgment n. o. v. entered in favor of plaintiff by the Court of Common Pleas of Fayette County. Action was instituted in assumpsit to recover $2,472 and interest from February 1, 1926, on two notes: one being dated July 14, 1923, in the sum of $1,000 payable to the order of the Peoples Bank of Greensboro (hereinafter referred to as “the bank”), and the other being dated October 24, 1923, in the sum of $1,472, and payable to the order of the bank.
