Quinn, Judge:

The Judge Advocate General of the Navy certified this case for review to determine the correctness of the decision by the Court of Military Review ordering a new action by the convening authority.

On a plea of guilty to two offenses in violation of the Uniform Code of Military Justice, the trial judge, sitting as a special court-martial without court members, sentenced the accused to a bad-conduct discharge, confinement at hard labor for three months, and accessory penalties.
