On July 28, 1943, the parties entered into a contract under seal by which the defendant agreed to sell and the plaintiff to buy “the land with buildings thereon situated at 15 Ashford St., Methuen, Mass.” This must be construed as including all the land under the building or buildings and at least as much more as was necessary to their beneficial enjoyment and within the power of the defendant to convey.
