The defendant appeals from an order striking from the files its notice of intention to move for a new trial.

The action was one to recover damages for the death of the plaintiff’s son. At the trial the jury returned a general verdict in favor of plaintiff for four thousand five hundred dollars. It also returned its verdict on certain special issues. The defendant moved the court, among other things, to direct entry of judgment in favor of the plaintiff for four hundred and five dollars, and the court granted the motion.
