Petitioner Jose Alex Fuentes, a New York State (“State”) prisoner convicted of rape in the first degree and sodomy in the first degree, appeals from a judgment of the United States District Court for the Eastern District of New York, Sandra L. Townes, Judge, denying his amended petition pursuant to 28 U.S.C. § 2254 for a writ of habeas corpus on the grounds that the prosecution suppressed a psychiatric record of an evaluation of the complainant, in violation of Fuentes’s due process rights, see Brady v.
