I. FACTUAL AND PROCEDURAL BACKGROUND

On January 17, 1996, now petitioner under 28 U.S.C. § 2254 Samuel Reyes Reyes was sentenced by the Bayamon Superior Court to 99 years of imprisonment for first-degree murder, and weapons law violations. Petitioner appealed that sentence and on December 30, 1999, the Puerto.Rico Court of Appeals affirmed the judgment of conviction. (Case No. KLAN1997-0671).
