MEMORANDUM OPINION AND ORDER

GOTTSCHALL, District Judge.

The U.S. Department of Health and Human Services (“HHS”) denied federal insurance coverage for a malpractice action against Dr. Godwin O. Onyema (“Onye-ma”). Ismie Mutual Insurance Company (“Ismie”) filed a four-count complaint against HHS seeking to overturn the denial of coverage. 1 Ismie asks this court to review HHS’s negative coverage determination under the Administrative Procedure Act (“APA”), 5 U.S.C. § 701, et seq.
