This case presents error from the county court of Haskell county, Oklahoma. February 4, 1908, plaintiff in error, as plaintiff, filed this petition in the said county court to recover of and from the above named defendant in error, as defendant, the sum of $34.40. Trial was had, and on the 5th day of August, 1908, judgment was rendered in favor of plaintiff and against the defendant. Whereupon, within due time, defendant filed motion for a new trial, which motion, however, was not considered or acted upon until February 9, 1909.
