MEMORANDUM OPINION
JORDAN, District Judge.
I. INTRODUCTION
Liveware Publishing, Inc. (“Liveware”) filed this breach of contract and copyright infringement action against Best Software, Inc. (“Best”) on March 19, 2002. (Docket Item [“D.I.”] 1.) Presently before the Court are Best’s Motion to Dismiss or, in the Alternative, Stay Proceedings Pending Arbitration (the “Motion”) (D.I.17), and Best’s application for an order requiring Liveware to treat as “Highly Confidential” certain information obtained by Liveware in response to a subpoena served on Best’s mailing agent.
