Defendant was charged with possession of heroin in violation of section 11500, Health and Safety Code, and a prior conviction under the same section. He pleaded not guilty and denied the prior, waived his right to a trial by jury, and submitted the cause on the transcript of the preliminary examination. After hearing additional evidence the trial court adjudged defendant guilty, found the prior conviction to be true, denied his motion for new trial and application for probation, and sentenced him to the state prison.
