I. Procedural Background
Pending before this Court is a Motion for Summary Judgment filed by EduCap, Inc. (“EduCap”) (Docket #30). On November 3, 1999, the debtor, Barney Sproli-to (“Sprolito”) filed a petition under Chapter 13 of the Bankruptcy Code (Docket # 1).
