In a proceeding upon notice of a motion for judgment, plaintiff, on June 5, 1924, recovered a verdict and judgment against defendant for $5,179.00, with interest and costs. To that judgment the present writ of error was obtained.

By the notice, dated April 19, 1924, and filed in the clerk’s office April 21, 1924, the defendant was warned that on May 16, 1924, which was the May term thereof, he would move the Circuit Court of Cabell County for a judgment against him for the sum of Five Thousand Dollars, with interest thereon from May 1, 1923, and costs of such motion, upon two…
