This was a notice of motion for judgment by J. W. Card-well, plaintiff below, against the Employers’ Liability. Assurance Corporation, Ltd., plaintiff in error, to recover disability benefits alleged to be due under an accident policy. Upon the trial of the ease by a jury on June 15, 1927, a verdict was returned for the plaintiff in the sum of $2,893.51, which included total disability benefits at $50.00 a week from November 12, 1925, to February 5, 1926, and partial disability benefits at $25.00 a week from February 5, 1926, to June 15, 1927, and medical fee of $15.00.
