This is an action of the case to recover damages for the alleged neglect of the town of East Greenwich to keep one of its highways in repair. It has already been before this Division on the plaintiffs’ petition for a new trial, 20 E. I. 443, and a new trial having been granted and the case having been tried again before a jury, wherein verdict was rendered for the plaintiffs in the sum of $2,000, it is now before us on the defendant’s petition for a new trial, and this time upon the allegations that the verdict was against the evidence ; that the justice at the jury trial admitted evidence…
