FURMAN, PresidiNg Judge.
The state moves to dismiss this appeal upon two grounds, viz.: First, that the pretended ■case-made does not contain the judgment of the trial court, from which defendant prosecutes this appeal and which he seeks to have reversed. Second, that the petition in error alleges that judgment was rendered against defendant on the 25th day of May, 1908, and that the alleged case-made was not served within the time prescribed by law for such service, and that the countv judge had not granted an order extending the time within which the case' must be served.
