Appeal from District Court, Pontotoc County; Robert M. Rainey, Judge. ¡Nelson Hawkins was convicted of manslaughter in the first degree, and his punishment was assessed at confinement in the penitentiary for 40 years, and he appeals.

FURMAN, PRESIDING Judge.

The judgment against the defendant was pronounced in this case on the 21st day of June, 1909, at which time appellant was allowed 90 days in which to make and serve a case-made. Thereafter, on the 20th day of September, 1909, the court granted 60 days additional time within which to make and serve a case-made. The case-made was not served on the county attorney until the 19th day of November, 1909. July and August each have 31 days.
