Appeal from a judgment of the Supreme Court (Malone, Jr., J.), entered August 5, 1999 in Albany County, which, in a proceeding pursuant to CPLR article 78, granted respondents’ motions to dismiss the petition for, inter alia, untimeliness.

Petitioner was employed as a correction officer by the Department of Correctional Services (hereinafter DOCS) until July 1996, when he accepted a temporary promotion to the position of correction sergeant.
